Paramedic injured in collision awarded $1.35M
A paramedic who was injured in an ambulance when a truck's load of debris fell on it was awarded $1.35 million. Jennifer Kwas was riding in the back of a city of La Porte ambulance while transporting a critical patient. The ambulance went through an intersection on a red light and a Lone Star Disposal truck driver veered to avoid it. The truck rolled over and part of its load fell on the ambulance. Kwas sustained a lacerated spleen. The plaintiff's accident reconstruction expert said the truck was going 40 mph when it entered the intersection and it was overloaded, both of which led to its rollover. The jury found negligence and comparative responsibility of 65 percent on Lone Star and 35 percent on its driver. It also found Lone Star grossly negligent.

Jury awards $299K for rear-ender
A jury awarded $299,109 to a driver who claimed shoulder, back and knee injuries in a rear-ender by a cement-mixer truck. Lee Contreras was hit by a driver for Buffalo Concrete of Texas, which stipulated to liability. Contreras claimed neck and back strains and sprains; a disc protrusion at T9-10; radicular pain and paresthesia in the buttocks and right shoulder; and a left knee contusion. He underwent cervical and lumbar medial branch blocks, and thoracic epidural steroid injections. He sought about $524,000 in damages. The defense orthopedic surgery expert opined that the injuries were only strains and sprains and a mild knee contusion.

Customer who fell in restaurant recovers $140K
A restaurant customer who tore his quadriceps muscle in a slip and fall on mopped floor recovered $140,251. Kyle Huse had been drinking at the bar of Center Court Pizza & Brew Pearland at closing time when the closing server started mopping up. The server was mopping when Huse got up and walked toward the exit to leave. He went a few steps and then slipped on the wet floor. He claimed workers didn't put out any warning signs before he fell, and he didn’t know the area had been mopped because it was to his back as he faced the bar. The defense contended that Huse was walking over to the closing server, a young woman, to flirt with her and was not watching carefully where he was walking. The court found Center Court 70 percent liable and Huse 30 percent liable. The judge awarded $200,359.48, which was reduced to $140,251.63.
